Terms and Conditions for the Sale of Tickets for Matches during the European Polo Championships in Sowiec

Chapter I
Definitions

  1. Ticket – A one-time authorization to enter the premises, containing the first name and last name;
  2. Client – A person who intends to purchase or has purchased a Ticket;
  3. Code of Good Practices – A set of conduct guidelines, adopted in accordance with applicable law in the form of ethical and professional norms to counteract dishonest market practices, which is applied by the Organizer;
  4. Account – An individual administrative panel accessible to the User after registration and logging into the System, identified by a username and password and used for concluding distance sales contracts;
  5. Match – A polo match organized at the Venue in Mosina, located at Sowiniec 1, featuring national polo teams;
  6. Venue – The facility located in Sowiec (Mosina municipality) at Sowiniec 1, including all buildings, outlets, rooms, and associated areas;
  7. Organizer or Association or Club – Sowiec Polo Club Association located in Sowiec: 62-050 Mosina, Sowiniec 1, registered in the Register of Entrepreneurs of the National Court Register (maintained by the District Court Poznań – New City and Wilda in Poznań, 9th Economic Division of the National Court Register) under KRS no. 0001104128, with NIP: 7773426012 and REGON: 528555841;
  8. Registration – The process by which the User creates an Account in the System;
  9. Tpay Service – An online service that enables quick internet payments (transfers) operated by Krajowy Integrator Płatności Spółka Akcyjna based in Poznań, 61-894 Poznań, at Pl. Władysława Andersa 3, registered in the entrepreneurs’ register maintained by the District Court in Poznań – New City and Wilda in Poznań (8th Economic Division of the National Court Register under KRS no. 0000412357, with a fully paid share capital of 5,494,980 PLN), holding tax identification number NIP: 7773061579 and REGON: 300878437;
  10. Force Majeure – Any circumstance arising from or attributable to actions, events, non-occurrences, or accidents that the Organizer could not reasonably foresee and that remain beyond the Organizer’s control, including (but not limited to) weather preventing polo matches, flooding, fire, explosion, earthquake, landslide, structural damage, epidemic or any other natural physical disaster, a lack or insufficient supply of power, satellite or other communications, military actions, riots, terrorist acts, or civil unrest.
  11. System or Service – The electronic ticket sales system available at www.polo2025.eu;
  12. Distance Contract – A contract concluded at a distance between the Organizer and the User, without their simultaneous presence, using the communication channels available in the System;
  13. User – A Client registered in the System who possesses an Account with an assigned username and password;
  14. Order – An instruction from the User to purchase a Ticket, which carries the obligation to pay for it.

Chapter II
General Provisions

  1. A Ticket can be purchased online via the System.
  2. Entry to any Match held at the Venue is conditional upon possessing an entry Ticket for that specific match.
  3. Copying or modifying the original Tickets is prohibited.
  4. The Ticket is considered the property of the person whose personal data are assigned to the document.
  5. A Ticket must not be transferred or resold to third parties without the Organizer’s consent.
  6. Entry for a Match using any given Ticket is granted exclusively to the Client who made the purchase.
  7. The Organizer reserves the right to change match dates at the request of the European Polo Championships organizer. In such cases, the purchased Ticket remains valid for the rescheduled match date.
  8. The Organizer may communicate any match date changes via the website www.polo2025.eu
  9. The Organizer reserves the right that some scheduled matches may be held without public attendance due to administrative decisions by the appropriate authority or disciplinary sanctions imposed by the European Polo Championships organizer. In such cases, the Buyer is not entitled to any claim against the Organizer due to being unable to attend the Match.
  10. The Organizer refuses to sell entry Tickets to persons:
    1. For whom a final court ruling has been issued that prohibits entry to mass events or mandates refraining from attending mass events (issued by a court against an individual subject to suspended imprisonment or, in the case of a minor, pursuant to Article 6(2) of the Act of 26 October 1982 on proceedings for minors, Journal of Laws 2002 No. 11, item 109, as amended);
    1. Against whom a stadium ban has been imposed by an authorized foreign entity, with such information reported to the Chief of Police.
  11. The Client is not entitled to any claim for inability to participate in a Match covered by the Ticket if this is due to the Client’s failure to comply with these Terms and Conditions, the Venue Regulations, the sports event Regulations, or other applicable statutory and local legal provisions.
  12. The Organizer will present the price lists for Ticket purchases for each day of the competition on its official website.
  13. The price list shall also be provided by the Organizer prior to the placement of Orders by Clients.
  14. The Organizer reserves the right to change the prices previously established for Tickets to selected matches.
  15. By purchasing an entry Ticket, the Client declares acceptance of these Terms and Conditions, the Venue Regulations, and the sports event Regulations, which are available on the Organizer’s official website.

Chapter III
Procedure for Concluding a Contract via the Service

  1. The Seller of entry Tickets within the System is the Organizer.
  2. The User agrees that the Organizer may use telephone, fax, email, an automated calling device, or any other means of electronic communication for correspondence purposes.
  3. The User uses the System on their own behalf.
  4. The User declares that they will use the System solely to purchase a Ticket.
  5. The User may place Orders in the Service 24 hours a day, 7 days a week—except during periods when the Service is unavailable for reasons beyond the Organizer’s control.
  6. A sales contract between the User and the Organizer is concluded at the moment when the User makes the payment and receives confirmation of the Ticket purchase via the User’s email address.
  7. Payment is considered complete once the required sum is credited to the Organizer’s bank account or upon receipt of a payment confirmation sent by the Tpay Service or another payment operator.
  8. Promotional vouchers cannot be combined.
  9. In a single transaction, only one voucher may be used unless the Organizer decides otherwise.
  10. The process of Ticket sales consists of several stages:
    1. Selection of the match day or any other product available in the Service.
    1. Selection of the number of Tickets from the specified categories.
    1. Entering payment information.
    1. Optionally selecting an alternative ticket delivery address.
    1. Self-printing of the Ticket.
    1. Acceptance of the payment method and entering of personal data.
    1. Reviewing and confirming all data entered by the User.
    1. Placing the Order by selecting the “order and pay” button.
    1. Payment by the User.
    1. Order confirmation by the Organizer.
  11. After logging out of the System and logging back in, the User cannot change the number of purchased Tickets by re-editing an already placed order.
  12. The Organizer ensures the confidentiality of all data entered into the System by securing such data against access by third parties. However, the data entered may be disclosed to third parties within the limits set by applicable law, in particular to the police, the public prosecutor’s office, and the courts.

Chapter IV
Price and Payments

  1. The types and prices of Tickets are determined by the Organizer.
  2. Ticket prices are set in Polish zlotys or in euros and include VAT.
  3. Prices are displayed by the Organizer in the System.
  4. The Organizer also designates the available payment methods for Orders placed in the System.
  5. Available payment methods are presented to the User prior to the placement of an Order.
  6. The amount due from a given Order must be settled immediately upon placing that Order.
  7. A transaction that is not paid for during the ordering process will be canceled. However, it is possible to retry the payment within a period not exceeding 15 minutes from its cancellation.
  8. After 15 minutes from the placement of an unpaid order, it will be ultimately canceled and deleted, and the User will have to restart the transaction.

Chapter V
Personal Data Protection Policy

  1. The processing of personal data is subject to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (which repealed Directive 95/46/EC) (Official Journal of the European Union L No. 119, p. 1), hereinafter referred to as the GDPR, as well as—in the case of Service Users—the provisions of the Act of 18 July 2002 on the provision of electronic services.
  2. The Organizer may process the following personal data of Clients necessary to establish, modify, or terminate the legal relationship between them:
    1. The Client’s first name and last name,
    1. The PESEL identification number or, if such a number has not been assigned, the passport number, identity card number, or another identity-confirming document,
    1. The email address.
  3. The Organizer may, with the User’s consent, process additional data concerning the User that is not essential for fulfilling the concluded contract. The purposes of processing such personal data are disclosed in the expressed consent or in the information clause.

Chapter VI
Ticket Refunds

  1. The Client is not entitled to a refund for an unused entry Ticket for reasons attributable to the Client.
  2. For purchases made through the Service, the Organizer informs that, in accordance with Article 38(12) of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827), the User is not entitled to withdraw from the Contract under Article 27 of the aforementioned Act.
  3. In the event that the Organizer is unable to fulfill its obligation and grant the User entry to a Match for any reason, the Organizer may be released from its obligation by providing a substitute performance in the form of enabling attendance at another Match.

Chapter VII
Final Provisions

  1. In matters not regulated by these Terms and Conditions, the relevant legal provisions applicable in the territory of the Republic of Poland shall apply. In particular, the following acts shall govern: The Act of 23 April 1964 – the Civil Code (Journal of Laws No. 16, item 93, as amended), The Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827), The Act of 29 August 1997 on the Protection of Personal Data (consolidated text: Journal of Laws 2002 No. 101, item 926, as amended), The Act of 20 March 2009 on the Security of Mass Events (Journal of Laws No. 62, item 504).
  2. The provisions of these Terms and Conditions are not intended to exclude or limit any rights of the User who is also a Consumer under the Act of 23 April 1964 – the Civil Code (Journal of Laws No. 16, item 93, as amended) as granted by mandatory legal provisions. In the event of any discrepancy between these Terms and Conditions and the aforementioned regulations, the latter shall prevail.
  3. The User has the opportunity to consult the Code of Good Business Practices. The Code is contained in the Act of 23 August 2007 on counteracting dishonest market practices. The current version of the Act is available at: http://isap.sejm.gov.pl/DetailsServlet?id=WDU20071711206.
  4. In the event of a dispute with the Organizer, the User may resolve the matter amicably by::
    1. Contacting the permanent consumer amicable court;
    1. Mediation;
    1. Contacting the regional inspector of the Trade Inspection;
    1. Obtaining free assistance for dispute resolution from the Consumer Federation by calling the free consumer hotline + 48 800 007 707.
  5. Changes to these Terms and Conditions may be made after prior notification of the Users regarding the scope of the anticipated changes, no later than 14 days before the changes come into effect.
  6. A User who does not agree with the changes introduced to these Terms and Conditions is entitled to deactivate their Account by sending an email to kontakt@sowiniecpoloclub.pl
  7. Orders placed during the validity of the previous version of these Terms and Conditions will be processed in accordance with its provisions.
